Learn to explain buyer agreement services, duration, compensation and touring rules with clarity before a client signs.
What a buyer agreement establishes
Written buyer agreements can define the scope of services, property area, duration, exclusivity, compensation and rules for changes or termination. Review the actual brokerage-approved form rather than relying on a generic online template. A written service agreement does not automatically create single-agent fiduciary representation under Florida law.
When the agreement is needed
Under the applicable National Association of REALTORS practice changes, MLS participants working with a buyer generally need a written agreement before touring a home together, including certain live virtual tours. Merely visiting an open house independently or talking with an agent about services does not itself require an agreement under NAR's consumer guidance. Check local MLS and brokerage requirements.
How to explain negotiable compensation
Explain exactly how compensation is determined, whether a seller or listing brokerage may contribute, and how a shortfall would be handled according to the document. There is no legally mandated standard buyer-agent commission. Do not tell a consumer that all agents charge an identical percentage.
Duration, scope and termination
A buyer should understand whether the arrangement is for one property, a defined area or a longer search. Discuss amendments and termination procedures in the form itself. Avoid promising that any agreement can be cancelled instantly without considering its actual terms.
A practice conversation for new agents
Ask a study partner to play the buyer and answer five questions: Who represents me? What services will you provide? Which homes does this cover? How much might I owe? How can the agreement end? Encourage the buyer to read the agreement and consult their own professional if they need legal advice.
