Florida Real Estate Referral Fees: A Checklist for New Agents

Understand why licensing status, brokerage oversight, written terms and settlement-service rules matter to referral fees.

Understand why licensing status, brokerage oversight, written terms and settlement-service rules matter to referral fees.

Start with licensing restrictions

Florida Statutes section 475.25(1)(h) addresses commission sharing and compensation for real estate referrals to improperly licensed persons. It can be a disciplinary violation to pay an unlicensed friend, neighbor or social-media influencer to refer buyers or sellers. A Florida broker may be permitted to share with a broker licensed in another jurisdiction under the statute's conditions; this is not a free pass for every arrangement.

Work through the brokerage

A sales associate should not personally negotiate and pay referral commissions outside the supervising brokerage. Confirm the referring party's licensed status and brokerage affiliation, and have the registered broker approve the arrangement before promises are made.

Put the terms in writing

A brokerage-approved referral agreement can identify the parties, client, triggering transaction, compensation calculation, expected records and expiration. Terms should be unambiguous about whether a closing is required and which party pays. Preserve the agreement and verify consent and confidentiality duties.

Distinguish advertising from referrals

An ordinary advertisement is not necessarily a client-referral fee, but labeling a payment as marketing does not change its substance. Payments tied to mortgage, title or other settlement referrals can also raise federal RESPA concerns. Seek a qualified review rather than treating a brokerage referral as authorization for other kinds of payments.

Practice the right response

A neighbor says, 'I'll send you a buyer if you give me $500 at closing.' Do not agree or process payment. Explain that the brokerage must evaluate whether compensation is legally allowed. If the referral comes from another licensed broker, the same discipline—verification, written terms, recordkeeping and broker approval—still matters.
